Agreement to These Terms

These Terms of Service govern your access to and use of Serra AI, a service provided by CJA Photography ("we," "us," or "our"). By purchasing a subscription, paying a setup fee, or using Serra AI in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the service.

What Serra AI Provides

Serra AI is an AI-powered chat assistant embedded on your business website. The service includes:

An AI chatbot that engages website visitors in real-time conversation
Lead capture functionality that collects visitor name and email
Chat transcripts delivered to you (the client) via Google Sheets
Initial setup, configuration, and onboarding of the chatbot on your website
Ongoing hosting and maintenance of the chatbot service during your active subscription

Serra AI is a lead-capture and engagement tool. It is not a licensed legal, financial, or medical advisor. We do not guarantee any specific business outcomes, lead quality, or conversion rates.

What Serra AI Does Not Provide

The following are explicitly outside the scope of Serra AI's service:

CRM software or integrations beyond Google Sheets delivery
Email marketing or automated follow-up campaigns
Website hosting, design, or development services beyond chatbot embed
Guaranteed uptime or uninterrupted service (see Section 8)
Any service not expressly described in Section 2

Fees, Billing & Payment

Serra AI charges a one-time setup fee and a recurring monthly subscription fee, as agreed at the time of purchase.

Setup Fee: $50 one-time fee, due at checkout. Covers configuration, onboarding, and deployment. Non-refundable once work commences.
Monthly Subscription: Standard plan — $79/month. Pro plan — $129/month. Billed on a recurring basis via Stripe. Covers hosting, maintenance, and chat transcript access.
Payment Processing: All payments are processed securely by Stripe. CJA Photography does not store card information on its servers.

Free Trial

14-Day Free Trial

New subscribers receive a 14-day free trial. During the trial period:

A valid credit or debit card is required at signup to activate the trial.
No charge is made during the 14-day trial period.
Three (3) days before the trial ends, you will receive an email reminder with the date and amount of the upcoming charge.
At the end of the trial, your card on file will be automatically charged the applicable monthly subscription fee and your subscription will begin.
If you cancel before the trial ends, no charge will be made and your chatbot will be deactivated at the end of the trial period.
The one-time $50 setup fee is charged at the time of checkout and is non-refundable regardless of trial cancellation.

Cancellation Policy

You may cancel your monthly subscription at any time by contacting us at cja@serrachat.com.

Cancellations take effect at the end of the current billing period. You retain access through that period.
Monthly subscription fees are non-refundable for the current billing period. No partial or prorated refunds.
The one-time setup fee is non-refundable under any circumstance.
Upon cancellation, your chatbot will be deactivated. Data is deleted upon written request to cja@serrachat.com.

Service Credit Exception: If Serra AI experiences extended downtime caused solely by CJA Photography — not due to third-party providers such as Anthropic or Stripe — clients may be eligible for a prorated service credit applied to the following month. Credits are not cash refunds.

Your Responsibilities as a Client

By using Serra AI, you agree to:

Provide accurate information during onboarding so we can configure the chatbot appropriately
Use Serra AI only for lawful business purposes in compliance with applicable laws
Not attempt to manipulate, reverse-engineer, or misuse the chatbot or underlying systems
Inform your website visitors that an AI chatbot is active on your site
Maintain the confidentiality of any credentials or access links we provide

Intellectual Property

Serra AI, its name, design, and underlying technology remain the property of CJA Photography. Your subscription grants you a limited, non-exclusive, non-transferable license to use the service during your active subscription.

You retain ownership of your business information and the leads collected through your chatbot. We do not claim any rights to the data your visitors submit.

Availability & Disclaimers

We work to keep Serra AI running reliably, but we cannot guarantee it will always be available. The service depends on third-party providers (AI, hosting, and data services) whose outages are outside our control.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CJA Photography disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

Data Retention & Deletion

Upon cancellation or termination of your account:

Chat transcripts and lead data are deleted upon written request to cja@serrachat.com
To request deletion, email cja@serrachat.com — we will confirm and complete deletion within 14 business days

Limitation of Liability

We are not responsible for lost profits, missed leads, or business interruption — whether caused by a service outage, AI error, or anything else outside our direct control.

If you have a claim against us, the most we can owe you is the total amount you paid us in the three months before the claim.

Governing Law

These Terms are governed by the laws of the State of California and the United States. Any disputes shall be resolved in the appropriate courts of California.

Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this page and notify active clients of material changes via email. Continued use of the service after changes constitutes acceptance of the updated Terms.
